Příspěvek vychází z komplexní analýzy problematiky vyvlastnění nemovitostí pro účely těžby nerostných surovin v České republice. Přiblíží argumenty pro a proti vyvlastnění, s důrazem na koncept veřejného zájmu a jeho interpretaci v judikatuře. Detailně rozebere současný právní rámec, včetně kategorií ložisek podléhajících vyvlastnění a procesních specifik, a to včetně potenciálních ústavněprávních otázek. Zvláštní pozornost bude věnována vztahu vyvlastnění k územnímu plánování a roli obcí. Závěrem budou diskutovány budoucí výzvy v této oblasti a vlivu měnících se geopolitických a environmentálních faktorů na těžbu nerostů, mj. v souvislosti se zajištěním energetické bezpečnosti v ČR.

The contribution is based on a comprehensive analysis of the expropriation of real estate for mineral extraction in the Czech Republic. It presents the arguments for and against expropriation, emphasising the concept of public interest and its interpretation in case law. It will analyse the current legal framework in detail, including categories of deposits subject to expropriation and procedural specifics, including potential constitutional issues. Particular attention will be paid to the relationship of expropriation to spatial planning and the role of municipalities. Finally, future challenges in this area and the impact of changing geopolitical and environmental factors on mineral extraction, including ensuring energy security in the Czech Republic, will be discussed.
