V Ústavě České republiky je dána přednost ratifikovaných mezinárodních smluv před zákony a tedy i podzákonnými právními předpisy. Přednost se však nevztahuje na ústavní zákony. Dle Ústavy má na území Čech, Moravy a Slezska závaznost ústavní norma, byť je v rozporu s právem EU, což jsou mezinárodní smlouvy (primární právo EU) nebo na základě něho vydaná nařízení a směrnice (sekundární právo EU). Článek uvádí vývoj problematiky v judikatuře Ústavního soudu.

The Constitution of the Czech Republic gives priority to ratified international treaties over laws and thus by-laws. However, this precedence does not apply to constitutional laws. From the point of view of the Constitution of the Czech Republic, a constitutional norm is binding on the territory of Bohemia, Moravia and Silesia, even if it is in conflict with EU law, which are international treaties (primary EU law) or regulations and directives issued on the basis of it (secondary EU law). The article presents the development of the issue in the jurisprudence of the Constitutional Court.
