Článek představuje základní souhrnnou právní informaci o mezinárodních (vnějších) sankcích, jež přijímá EU. Podstatou je rozlišení těchto sankcí na ty, které provádějí sankce Rady bezpečnosti OSN v nezměněném rozsahu (prováděcí sankce), oproti těm, které buď rozsah původních sankcí rozšiřují (doplňkové sankce), anebo jsou na nich nezávislé (autonomní sankce). Dále se článek věnuje právním aktům EU, kterými se tyto sankce ukládají: zde se jedná zejména právní problémy vyplývající z rozdělení pravomocí mezi EU a jejími členskými státy, zejména mezi výlučnou pravomocí EU v oblasti společné obchodní politiky oproti převážně mezivládní společné zahraniční a bezpečnostní politice EU, ovládané Radou EU, tj. členskými státy. Článek se také zabývá prováděním vnějších sankcí EU členskými státy EU a jejich soudnímu přezkumu, zejména Soudním dvorem EU. Zvláštní pozornost je věnována jednak lidskoprávním aspektům celé problematiky, jednak právním problémům, které vznikají z kolizí s jinými autonomními sankčními systémy, zejména se sankcemi USA.

The article provides a basic legal summary of the international (external) sanctions adopted by the EU. The essence is to distinguish between those sanctions that implement UN Security Council sanctions unchanged (implementing sanctions) versus those that either extend the scope of the original sanctions (additional sanctions) or are independent of them (autonomous sanctions). Next, the article looks at the EU legal acts imposing these sanctions: here the main legal issues are those arising from the division of powers between the EU and its Member States, in particular between the EU's exclusive competence in the field of the Common Commercial Policy versus the largely intergovernmental Common Foreign and Security Policy of the EU, controlled by the EU Council, i.e. the Member States. The article also discusses the implementation of external EU sanctions by EU member states and their judicial review, in particular Particular attention is paid to both the human rights aspects of the whole issue, on the one hand, the legal problems arising from conflicts with other autonomous sanction systems, in particular with US sanctions.
