Článek věnuje pozornost návrhu a předkládá kritickou analýzu návrhu zákona o statusu veřejné prospěšnosti, který i přes negativní stanovisko LRV, schválila Vláda ČR.

The new Czech Civil Code (in effect from January, 1th, 2014) conceptually grasped „public benefit“ as a "feature" or "character" of a legal person whose purpose is to contribute to the achievement of the common good regardless of the chosen legal form. At the same time, Section 147 CC foresees the adoption of a special regulation that would allow the registration of the public benefit status in the public registry of legal persons. In January 2017, the Government of the Czech Republic submitted to the Chamber of Deputies of the Parliament of the Czech Republic a draft of such a regulation on public benefit status for discussion. Unfortunately, the draft suffers from a general conceptual and content defect, value-based inaccuracy, and, last but not least, inadequate interdependence with the rest of the legal order. In the case of its adoption, it could eventually lead to bad consequences, which is an effect quite opposite to what the government promises
