Příspěvek se zabývá interpretací právně relevantních textů, které nicméně nejsou objektivním právem. Typicky se jedná o různá pravidla, či doporučení, souhrnně tedy ne-právo. Podle jakých pravidel by pak mělo být ne-právo interpretováno? Příspěvek se následně zaměřuje na interpretaci Pravidel UNCITRAL pro mezinárodní rozhodčí řízení a zamýšlí se nad jejich interpretací jako ne-práva. Relevantním kontextem je přitom oblast mezinárodní investiční arbitráže. Článek ústí v závěr, že pokud na Pravidla UNCITRAL odkazuje mezinárodní smlouva, měla by být pro jejich výklad použita pravidla interpretace mezinárodních smluv.
In English
The paper deals with interpretation of non-legal instruments in international law. The pivotal question is according to which rules should they be interpreted? The paper focuses namely on interpretation of the UNCITRAL Arbitration Rules and submits some thoughts on their interpretation as a non-law. The relevant context then is international investment arbitration. The paper concludes that if an international treaty refers to the UNCITRAL Arbitration Rules, the interpretation rules for international treaties should apply thereto.
