Autoři se věnují možnosti ochrany práv osob ve veřejné službě, jež mají specifické postavení ve vztahu ke státu jako svému „zaměstnavateli“. Příspěvek je zaměřen na obecné otázky vztahů ve veřejné službě, zejména pak ve služebních poměrech, v nichž převažuje veřejnoprávní prvek, což je spojeno s otázkou ochrany (subjektivních) práv osob v těchto poměrech. Příspěvek se rovněž věnuje analýze judikatury, kdy poukazuje na nejčastější případy, kdy k ochraně práv byla využita i moc soudní.

The theme reflects the highly topical issues. The authors focused on the possibility of protecting the rights of people in public service who have a specific position in relation to the state as their “employer”. Therefore, the contribution focused on general issues of relations in the public service, especially in public service employment, in which dominates public element, and it is connected to the issue of (subjective) rights of individuals in these relationships. The contribution also deals with the analysis of case law, which refers to the most frequent cases where the judicial power was also used for protection of the rights.
