Příspěvek se zabývá institutem spolupracujícího obviněného, který byl zaveden do trestního řádu zákonem č. 41/2009 Sb., jenž nabyl účinnosti dne 1. ledna 2010. V úvodu je provedena analýza platné a účinné právní úpravy tohoto institutu, načež jsou rozebrány rizikové body právní úpravy související zejména s fází přidělení a odnětí statusu spolupracujícího obviněného. V závěru jsou uvedeny návrhy de lege ferenda.

The paper deals with the concept of the cooperating accused, which have been enacted to the Czech penal proceeding in the amendment of the Code of Criminal Procedure, Act No. 41/2009 Coll., which came into effect on 1st January 2010. In the introduction the author analyses the legal regulation of the cooperating accused and subsequently analyses the critical issues related especially with the controls that are exercised when the status is given or taken away. At the end there are prompts for improvement of this regulation.
