Proměny pozdně moderní společnosti a rostoucí varieta a komplexita práva přináší i v kontinentálním právním systému nutnost soudcovské tvorby práva v obtížných případech, kdy proces výkladu práva i s využitím dostupných interpretačních postupů nevede k jednoznačnému konkrétnímu řešení daného případu.

Transformation of late modern society and the growing variety and complexity of law bring also in the continental legal system the need for judicial law-making in hard cases, when the process of interpretation of law through the use of available interpretative techniques does not lead to a definite solution of the given particular case.
